HB3782 which proposes a prohibition of employers asking job applicants’ their social network passwords is on hold due to conflicting language.

A provision in the Bill allows an employer to “maintain lawful workplace policies” with regard to electronic equipment and investigating unlawful or improper activity.  That language may come into conflict with the password prohibitions if an employer asks for the password under its investigatory power granted in the Bill.

Because the aim of the Bill is to protect both employees and employers, the Bill is being reworked and then will be presented to the House for a vote.
